Jobs Act in public employment

After some initial doubt regarding the application of the new individual dismissal law on public employment, the Government has repeatedly reiterated that the Jobs Act does not apply to the public employment and that this matter could be regulated under the law on delegating public administration reform (c.d. Riforma Madia).

However, the position taken by the Executive Commission is not acceptable, given that the most used argument – more political than legal - according to which labour reform was designed and written for private workers and to give private companies more flexibilities, this reform could not whatsoever permit that rules of positive law (see D.Lgs. 165/2001) can be changed "implicitly".
