Illegal the disciplinary dismissal ( Fornero Law) if the CCNL (National Labour Contracts) provides a conservative penalty

In case of disciplinary dismissal, if the applicable collective agreement provides for the infringement, in lieu of expulsion sanction, a conservative character, the dismissal is illegal and the employee is entitled to reinstatement in the workplace. The case decided by the Tribunal of Milan (the sentence. 6150/2015 of 13th JULY 2015, Judge Mariani) was prompted by the disciplinary dismissal notice, after a suspension from service as a precaution, against a worker for having addressed in a manner disrespectful to employees of an external company and specifically for having compared the employees to "whores in Switzerland".
